Sponsor Licence Changes in 2026: Six Actions for Employers

The Home Office has introduced several changes affecting sponsor licence holders. These cover Sponsorship Management System (SMS) security, Level 2 Users, right-to-work checks, eVisas and Skilled Worker salary compliance.
Here is a practical summary of what employers need to know and do.
Key dates
3 September 2026: Phased introduction of multi-factor authentication for SMS users
9 September 2026: No new Level 2 Users can be appointed
1 October 2026: Wider right-to-work requirements take effect
November 2026: Full implementation of SMS multi-factor authentication is expected
8 March 2027: Deadline to convert or deactivate existing Level 2 Users
1. Prepare SMS users for multi-factor authentication
Multi-factor authentication (MFA) is being introduced for all SMS users. Once activated, users must enter a one-time passcode as well as their username and password.
The code will normally be sent:
by text message to a Level 1 User’s registered mobile number; or
by email where no valid mobile number is recorded and for existing Level 2 Users.
Sponsors should check that every SMS user’s personal email address, mobile number and date of birth are correct.
Email accounts must be secure, belong to the named user and not be shared with other staff.
New sponsor licences granted on or after 9 September 2026 will have MFA enabled automatically.
2. Review Level 2 Users before March 2027
Sponsors can no longer appoint new Level 2 Users.
Existing Level 2 User accounts must be dealt with by 8 March 2027. A Level 1 User must either:
convert the person to a Level 1 User, if they meet the eligibility requirements; or
deactivate the person’s SMS account.
After the deadline, the Home Office will deactivate any remaining Level 2 User accounts.
Employers should also ensure that at least one eligible and active Level 1 User remains in place. Ideally, there should be enough Level 1 User coverage for holidays, sickness and staff departures.
3. Keep SMS accounts active
An SMS account may be treated as inactive if the user has not accessed it for 12 months or more.
Where an inactive account is identified, the Home Office will normally contact the Authorising Officer and the affected Level 1 User. The user will usually have three months to log in, check their details and make any necessary updates.
If removing inactive accounts leaves the organisation without an active Level 1 User, the Home Office may suspend the sponsor licence. The organisation will then normally have 28 days to appoint an eligible Level 1 User.
Sponsors should:
review all SMS users;
remove access for anyone who has left or no longer needs it;
ensure active users log in regularly; and
review SMS users and Key Personnel every quarter.
4. Update right-to-work procedures before 1 October 2026
From 1 October 2026, the Right to Work Scheme is due to extend beyond traditional employees. It may also cover people working under:
worker contracts;
individual subcontracting arrangements;
certain employment business or platform arrangements; and
online matching services.
Whether the requirements apply will depend on how the working arrangement operates in practice, not simply how it is described in the contract.
Independent businesses and genuine business-to-business arrangements may remain outside the scheme, but each arrangement should be assessed individually.
Employers should review their arrangements with contractors, employment businesses and service providers. Contracts should clearly state who is responsible for:
carrying out right-to-work checks;
retaining evidence;
sharing relevant information; and
taking action if illegal working is identified.
Sponsor licence holders must already check and retain evidence of the immigration status of all sponsored workers, including those who are not directly employed by them.
5. Complete the correct eVisa check
Sponsored workers will now generally receive an eVisa rather than a physical visa vignette.
A visa approval email or decision letter is not evidence of a person’s right to work.
Before employment begins, employers must complete the prescribed right-to-work check. Where the worker has an eVisa, this must be an online check using the Home Office service and the worker’s share code.
Employers must retain evidence of the completed check and, where required, evidence of the worker’s date of entry to the UK.
6. Check Skilled Worker salary compliance
For workers sponsored using a Certificate of Sponsorship assigned on or after 8 April 2026, the required salary must be maintained during each relevant pay period.
The Home Office can compare PAYE information held by HMRC with the salary, working hours and occupation details recorded on the Certificate of Sponsorship.
Sponsors should ensure that:
payroll matches the salary and weekly hours stated on the CoS;
the worker receives at least the applicable going rate for the hours worked;
unpaid leave, salary reductions and irregular working patterns are recorded correctly;
reportable salary or employment changes are submitted through the SMS on time; and
payroll records, employment contracts and attendance records remain consistent.
Employer action checklist
Sponsor licence holders should now:
audit their SMS users and Key Personnel;
update SMS contact details for MFA;
review inactive and Level 2 User accounts;
update right-to-work procedures before 1 October 2026;
compare sponsored workers’ payroll records with their CoS details; and
check that reportable changes have been submitted within the applicable 10 or 20 working-day deadline.

英国内政部近期推出了几项重要变更,涉及担保管理系统(Sponsorship Management System,SMS)、RTW核查以及受担保员工的管理。
我们已将主要变更及担保雇主目前应采取的行动整理如下。本内容更新至2026年9月18日。
1. SMS用户将启用多重身份验证
自2026年9月3日起,所有SMS用户将分阶段强制启用多重身份验证(MFA),预计于2026年11月全面实施。
启用MFA后,用户除输入用户名和密码外,还需输入一次性验证码。验证码通常会通过以下方式发送:
· 短信发送至一级用户(Level 1 User)已登记的手机号码;或
· 如未登记有效手机号码,或对于现有二级用户(Level 2 User),则通过电子邮件发送。
担保雇主应确保每位SMS用户的个人电子邮箱、手机号码和出生日期均已准确登记。电子邮箱账户必须安全、专属指定用户本人,不得与其他员工共用。
2026年9月9日或之后获批的新担保牌照将强制启用MFA。
2. Level 2 Users将逐步取消
自2026年9月9日起,担保雇主不得再新增二级用户。
所有现有Level 2 (二级用户) 必须在2027年3月8日前完成处理。Level 1 User(一级账户)必须选择以下其中一项:
· 如该人员符合资格要求,将其转为Level 1 user;或
· 停用该人员的SMS账户。
2027年3月8日后,英国内政部将停用任何仍存在的二级用户账户。
雇主应审查哪些人员确实需要登入SMS,并确保至少保留一名符合资格且账户有效的一级用户。建议保留足够的一级用户人数,以应对休假、病假或人员离职。
3. 长期未使用的SMS账户可能令担保牌照面临风险
如用户连续12个月或更长时间未登录,其SMS账户将被视为不活跃账户。
如英国内政部发现不活跃账户,将联系AO(Authorising Officer)及受影响的一级用户。有关用户通常有三个月时间登录账户、核对个人资料并完成必要更新。
如删除不活跃账户后,机构不再有任何有效的一级用户,英国内政部可能暂停其担保牌照。担保雇主届时有28天时间指定一名符合资格的一级用户;如未能做到,牌照通常会被吊销。

· 立即审查所有SMS用户;
· 移除已离职或不再需要访问SMS的人员权限;
· 确保每名有效用户定期登录;以及
· 每季度审查SMS用户和关键人员(Key Personnel)。
4. 自2026年10月1日起扩大工作权核查范围
自2026年10月1日起,工作权核查制度(Right to Work Scheme)的适用范围将不再限于传统雇员,并可能涵盖通过以下安排从事工作的个人:
· 劳工合同;
· 个人分包安排;
· 特定的用工业务或平台安排;以及
· 在线工作匹配服务。
在某些合同链中,如发现实际从事工作的个人属于非法工作,相关企业也可能承担更广泛的责任。新规定是否适用,将取决于有关安排的实际运作方式,而不仅是合同中的表述。
独立经营者及真实的企业对企业服务安排可能仍不在该制度范围内。因此,每项安排都应单独评估。
担保雇主及其他雇主应在2026年10月1日前审查其与承包商、职业介绍机构和服务供应商之间的安排。合同应清楚界定由谁负责工作权核查、记录保存、信息共享,以及发现非法工作后应采取的行动。
担保牌照持有人现已必须核查并保存每名受担保员工的移民身份凭证,包括并非由其直接雇用的受担保员工。
5. eVisa与受担保员工入职
英国内政部已完成针对受担保员工的更广泛数字移民身份过渡。申请获批者如今通常会获得eVisa,而非实体签证贴纸。
签证批准电子邮件或决定信不能作为RTW工作权证明。雇佣开始前,雇主必须按规定完成工作权核查。如员工持有eVisa,雇主必须使用英国内政部在线服务及该员工的共享代码(share code)完成在线核查。
担保雇主必须保存已完成核查的证据,并在规定情况下保存该员工入境英国日期的证据。
6. Skilled Worker签证的工资合规
对于使用2026年4月8日或之后签发的担保证明(Certificate of Sponsorship,CoS)获得担保的员工,雇主必须确保其在每个相关工资周期内均达到规定工资水平。
英国内政部可将英国税务海关总署(HMRC)持有的PAYE信息,与CoS所记录的工资、工作时数和职业资料进行比对。因此,担保雇主应确保:
· 工资记录与CoS所列工资及每周工作时数一致;
· 员工所得工资至少达到其实际工时所适用的职业标准工资(going rate);
· 获准的无薪休假、减薪及不规律工作安排均已正确记录;
· 任何须报告的工资或雇佣情况变更,均在规定期限内通过SMS提交;以及
· 工资记录、雇佣合同和考勤记录保持一致。
建议立即采取的行动
建议所有担保雇主立即:
· 审查SMS用户和关键人员;
· 更新联系资料,为启用MFA做好准备;
· 审查或移除不活跃账户及二级用户账户;
· 在2026年10月1日前更新工作权核查程序;
· 将受担保员工的工资记录与其CoS资料进行核对;以及
· 确保所有须报告的变更均在适用的10或20个工作日期限内提交。

2. レベル2ユーザーの段階的廃止
2026年9月9日以降、スポンサーは新たなレベル2ユーザーを任命できません。
既存のレベル2ユーザーについては、2027年3月8日までに対応する必要があります。レベル1ユーザーは、次のいずれかを行わなければなりません。
· 当該ユーザーが資格要件を満たす場合、レベル1ユーザーに切り替える、または
· 当該ユーザーのSMSアカウントを無効化する。
2027年3月8日以降も残っているレベル2ユーザーのアカウントは、Home Officeにより無効化されます。
スポンサーは、SMSへのアクセスを本当に必要とする人を見直し、資格要件を満たす有効なレベル1ユーザーを少なくとも1名確保してください。休暇、病気による欠勤、退職などに備え、十分な数のレベル1ユーザーを維持することをお勧めします。
3. 長期間利用されていないSMSアカウントはライセンス上のリスクとなります
ユーザーが12か月以上アクセスしていないSMSアカウントは、非アクティブとみなされます。
Home Officeが非アクティブなアカウントを確認した場合、Authorising Officerおよび対象となるレベル1ユーザーに連絡をします。対象ユーザーは3か月以内にログインをして登録内容を確認し、必要な更新を行うことになります。
非アクティブなアカウントの削除により、組織内に有効なレベル1ユーザーがいなくなる場合、Home Officeはスポンサーライセンスを一時停止することがあります。その場合、スポンサーは28日以内に資格要件を満たすレベル1ユーザーを任命する必要があり、対応しなければ通常、ライセンスは取り消されます。

4. 2026年10月1日から就労資格確認の対象範囲が拡大

· worker契約(worker contracts)
· 個人との下請契約

契約関係が多層的な場合、実際に業務を行う者の違法就労が判明すると、企業がより広範な責任を負う可能性もあります。新規定が適用されるかどうかは、契約書上の名称だけでなく、実際の運用によって判断されます。
独立した事業者や、真正な企業間(B2B)のサービス契約は、引き続き制度の対象外となる可能性があります。そのため、各契約形態を個別に確認する必要があります。
スポンサーおよびその他の雇用主は、2026年10月1日までに、請負業者、人材供給事業者およびサービス提供者との契約関係を見直してください。契約書には、就労資格確認、記録保存、情報共有、および違法就労が判明した場合の対応について、責任の所在を明確に定める必要があります。
スポンサーライセンス保有者は、直接雇用していない人も含め、すべてのスポンサー対象者の在留資格を確認し、その証拠を保管する義務があります。
5. eVisaとスポンサー対象者の入社手続き
Home Officeは、スポンサー対象者の在留資格のデジタル化に向けた広範な移行を完了しました。申請が承認された方には通常、物理的な査証ではなくeVisaが発行されます。
ビザ承認メールまたは決定通知書は、就労資格の証明にはなりません。雇用開始前に、雇用主は所定の就労資格確認を完了しなければなりません。対象者がeVisaを保有している場合は、Home Officeのオンラインサービスと本人のシェアコード(share code)を使用して確認する必要があります。

Home Officeは、HM Revenue and Customs(HMRC)が保有するPAYE情報と、CoSに記録された給与、労働時間および職種情報を照合できます。したがって、スポンサーは次の点を確認してください。
· 給与記録が、CoSに記載された給与額および週当たりの労働時間と一致している。
· 実際の労働時間に基づき、該当する職種別基準給与額(going rate)以上の給与が支払われている。
· 認められる無給休暇、減給および不規則な勤務形態が正しく記録されている。
· 報告対象となる給与または雇用条件の変更が、所定の期限内にSMSを通じて報告されている。
· 給与記録、雇用契約書および勤怠記録の内容が一致している。
推奨される対応
すべてのスポンサーに、次の対応を今すぐ行うことをお勧めします。
· SMSユーザーおよびKey Personnelを確認する。
· MFA導入に備えて連絡先情報を更新する。
· 非アクティブなアカウントおよびレベル2ユーザーのアカウントを確認し、必要に応じて削除する。
· 2026年10月1日までに就労資格確認の手順を更新する。
· スポンサー対象者の給与記録とCoSの内容を照合する。
· 報告対象となるすべての変更が、該当する10営業日または20営業日の期限内に報告されていることを確認する。
